Introduction.
Website Owner. Uptrend Credit Solutions, Inc. (“Uptrend,” “we,” “us,” or “our”) owns the website located at www.uptrendcredit.com (“Website”). This online privacy notice (the “Privacy Policy”) describes and discloses our information practices for this Website, including what type of personal identifiable information (“PII”) we request from customers to complete transactions, how PII is used, and how and with whom we share user information. Note that other Uptrend websites may be governed by privacy notices containing different information practices applicable to those sites. As used in this Privacy Notice, “you” refers to the user using or accessing the Website for any reason, whether a paying/registered customer, an individual, or on behalf of an entity. A “customer” is a registered subscriber to our service(s).
Policy Changes. Uptrend may periodically change this Privacy Policy as we offer new products and services or evolve our existing products and services. Privacy policies are dated to reflect the most recent update.
Web Site Visits. In general, you can visit the Website without disclosing any personal information. Uptrend does keep track of the domains from the users that visit us.
Website Transactions. At times, Uptrend will need personal information regarding a customer or prospect. For example: to process an order or provide a subscription, Uptrend may need to know a customer’s name, social security number, mailing address, e-mail address and credit card details. Uptrend intends to inform you before Uptrend collects personal information on the Internet. If you tell us that you do not wish to have this information used as a basis for further contact with you, send an request to support@uptrendcredit.com, and Uptrend will respect your wishes.
Links to Other Websites. The Website may contain links to other websites. Uptrend is not responsible for the privacy practices or the content of those other websites.
Personal Information That May Be Collected.
Personal Identifiable Information. To make a purchase or access designated customer services and/or restricted areas in the Website, Uptrend will request that the user provide certain Personal Identifiable Information (“PII”), which may include: name, social security number, postal address, e-mail, screen name and password, phone number, method of payment, and, if applicable, credit card number. Uptrend may request additional information necessary to establish and maintain the customer’s account.
Service Quality Monitoring. Some Website transactions may require you to call Uptrend, or Uptrend to call you. Uptrend will not contact you by telephone without your prior consent, except to confirm an order placed online and/or to inform you of the order status. Please be aware that it is our practice to monitor, and in some cases record, such calls for staff training or quality assurance purposes.
Information from Children. Uptrend does not sell products or services for purchase by children, and will not collect or post information from a child under the age of 16 without the involvement of a parent or guardian. Uptrend will notify the child’s parent/guardian at the email address provided by the prospective customer, alerting the parent/guardian to the child’s use of the Website and providing instructions as to how the parent or guardian can delete the child’s registration from the Website. Uptrend does not use PII collected from children for marketing or promotional purposes, and does not disclose such information to any third party for any purpose whatsoever.
Lost or Stolen Information. If a customer’s credit card is lost or stolen, they should promptly notify Uptrend so that we can cancel the lost or stolen information and update our records with a changed credit card.
How We Use the Information.
Limited Uses Identified. Uptrend will use personal information we collect for transaction-related purposes and the following purposes: such as for statistical analysis of customer’s behavior; for product development; for content improvement; to customize the content and layout of the Website; for internal company reviews
Marketing Uses. Unless the customer checks the opt-out option box provided, we reserve the right to inform that customer about Uptrend’s Website, products and services, and related information in which the customer has indicated an interest. The information a customer provides to the Website may also be collected, used, analyzed and/or processed by Uptrend, or selected third parties on Uptrend’s behalf, for marketing and other business purposes. Before we use the information, however, we will notify customers and offer the opportunity to opt-out if a customer wishes not to have PII used in this way.
Stored Information Uses. Uptrend stores and retains the information provided by customer OR the information entered on the Website. This information is used to compile a customer’s purchase history in order to enable Uptrend to recommend products, services, or special offers that would be of interest to a customer. Stored information is used by Uptrend and/or Uptrend agents: to support customer interaction with the Website; to deliver customer purchases; and/or to contact the customer again about other Uptrend services and products.
Online Advertising. Some companies that help Uptrend deliver interactive online advertising (e.g., banner ads) may collect and use information about customers to help us better understand the most appealing types of advertising or promotions for our customers and prospects. The information is aggregated after it is collected, so it is not identifiable to a specific individual. If, however, you would prefer that these companies not collect such information, please mark the opt-out option box provided.
Disclosure of the Information.
Mergers and Acquisitions. For the purpose of developing and expanding its business, Uptrend may share, rent, sell or buy business assets. In such transactions, customer information is generally one of the transferred business assets. Also, in the event Uptrend is acquired, customer information will be one of the transferred assets.
Agents. Uptrend employs or engages other companies and individuals to perform business functions on our behalf. They receive PII required to perform their functions, but are contractually prohibited from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to: fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments and providing customer services.
Affiliated Businesses. Uptrend works closely with affiliated businesses operating online stores, providing services or selling products on each other’s websites. These businesses identify themselves to customers. Customer information related to a transaction with an affiliated business is shared with that affiliated business.
Marketing Analysis by Third Parties. Uptrend reserves the right to disclose to third parties personal information about users for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual customer.
Disclosure to Governmental Authorities. Uptrend may release PII when we reasonably believe release is appropriate to comply with the law, to enforce Uptrend agreements, or to protect the rights, property or safety of our customers. Uptrend may also release such information in an exchange of information with other companies and/or organizations for the purposes of fraud protection and credit risk reduction.
Use of Computer Tracking Technologies.
No Tracking of Personal Information. The Website is not set up to track, collect or distribute personal information not entered by visitors. Our site logs do generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff to provide better services to the public and may also be provided to others, but, again, the statistics contain no personal information and cannot be used to gather such information.
Cookies. A “cookie” is a small amount of data that is sent to your browser from a Web server and is stored on your computer’s hard drive. Uptrend uses non-identifying cookies to make navigating the site easier. Our Website can still be used if your browser is set to reject cookies. Uptrend’s cookies do not generate personal data, do not read personal data from your machine and are never tied to anything that could be used to identify you.
Web Beacon Technologies. Uptrend may also use Web beacons or other technologies to provide better customer service via the Website. If these technologies are in use, when you access these pages of the Website, a non-identifiable notice of that visit is generated, which may be processed by Uptrend or by its suppliers. Web beacons usually work together with cookies. If you do not want cookie information to be associated with your visits to these pages, you can set your browser to turn off cookies. Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.
Collection of Non-Identifiable Information. Uptrend may collect non-identifiable information from your visits to the Website, called “clickstream data,” to provide better customer service. Examples include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on the Website; Website and system administration; user analysis; and business decision making. Uptrend or its contractors may use clickstream data to analyze trends and statistics.
Collection of Personal Information. Uptrend collects PII from customers during a transaction. We may extract some PII about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help Uptrend understand trends and patterns. Again, this information is not reviewed at an individual level.
Information Security.
Our Commitment to Online Security. Uptrend and their agents use industry standard encryption technologies when transferring and receiving PII. We maintain security measures in our physical facility designed to protect against the loss, misuse or alteration of information that Uptrend has collected from the user.
No Liability for Acts of Third Parties. Uptrend will exercise all reasonable efforts to safeguard the confidentiality of customer PII. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, Uptrend shall not be liable for unauthorized disclosure of PII due to no fault of Uptrend, including, but not limited to, errors in transmission and unauthorized acts of Uptrend staff and/or third parties.
Opt-Out Right. Customers and/or prospective customers have the right at any time to stop allowing PII to be collected, used or disclosed by Uptrend and/or by any third parties with whom Uptrend has shared and/or transferred such personal information. The right of cancellation may be exercised by contacting Uptrend via e-mail at info@uptrendcredit.com, by phone at (833) 425-0355, or by certified postal mail at 6301 NW 5th Way, Suite 5000, Fort Lauderdale, Florida 33309. After processing the cancellation, we will delete customer or prospective customer’s personal information from our database.
Access Rights to Data.
Information Uptrend Maintains. Upon customer’s request, Uptrend will provide a reasonable description of customer’s PII that we maintain in our databank. Corrections and Changes to Personal Information. Help us keep customer personal information accurate. If a customer’s personal information changes, or if the customer notes an error when reviewing their information that Uptrend has on file, please promptly e-mail Uptrend at info@uptrendcredit.com and provide the new or correct information.
Your California Privacy Rights. Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of Uptrend who are California residents to request certain information regarding Uptrend’s disclosure of personal information for their direct marketing purposes. You will find further information and instructions on making such a request below. Within 30 days of receiving such a request, Uptrend will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. Uptrend reserves its right not to respond to requests submitted other than to the address specified below.

CCPA Privacy Rights and Policies. California law requires us to provide to California residents certain information about the categories of personal information we collect. For this section, “Personal Information” has the meaning provided by the California Consumer Privacy Act (the “CCPA”) and may exclude certain information that is publicly available, deidentified, aggregated, subject to the Fair Credit Reporting Act, GLBA, HIPAA, or the Driver’s Privacy Protection Act of 1994, or otherwise exempt or excluded from the CCPA.

We may sell to a third party personal information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.
You have the right under the CCPA and certain other privacy and data protection laws, as applicable, to opt-out of the sale of your personal information. Consumer Information Privacy Policy For FCRA-Governed Consumer Reports. Uptrend facilitates reports from consumer reporting agencies. It is required by the Fair Credit Reporting Act, 15 U.S.C. §1681 et seq. (“FCRA”) to maintain the confidentiality of all consumer information.
Uptrend obtains information of an individual consumer only upon the request of a user who has a permissible purpose under the FCRA to request information about that consumer in order to provide consumer reports. The FCRA requires a user for employment purposes to certify to us that there is a permissible purpose for the report and we have obtained the written consent of the consumer to request information before we can supply the requested information. The user must submit to reasonable audits by us to confirm that we are, in fact, obtaining such consents. All users must certify that they have a permissible purpose to request a report, such as credit, insurance, and renting an apartment. We agree to keep your information confidential and secure.
Personal Information Disclosure, United States or overseas. We do not send consumer information outside of the United States or its territories for any purpose other than to deliver a report to an end user. Of course, if information is sought from outside of the United States, the information is gathered in that country and then transmitted to us here in the United States where it is treated as any other consumer information. Any information gathered about any consumer may only be provided to the user authorized by the consumer or permitted by the FCRA or similar state law to receive the information. We cannot and do not share, sell or distribute consumer information with or to any third party other than the requesting party thereof.
Any consumer, upon proper identification, has the right under the FCRA to request us to furnish to the consumer any and all information we may have on that consumer. The consumer has the right to dispute the accuracy or completeness of any information contained in the consumer’s file. We may be required, upon court order, to release the information in civil litigation, or as otherwise required by law, to disclose information regarding a consumer to law enforcement agencies.
